With regard to a petition filed against alleging a fraudulent debit transaction from a man's bank account, named Manmohan Kumar, the Delhi High Court has requested a response from the Reserve Bank of India and HDFC Bank [Manmohan Kumar v. Reserve Bank of India and Others].

Justice Vikas Mahajan in a plea has sent out a notice asking for an investigation into HDFC Bank's operations as well as orders to rectify the illegal transactions. Manmohan Kumar, the petitioner has complained that amount of Rs 74,61,990 was fraudulently debited from his HDFC Bank account. He stated that it was done after the unauthorized changing of his registered mobile number and email ID linked with the account.

The bank statements of the man allegedly shows an unauthenticated registered email ID as ‘loveofhdfc@gmail.com’ and mobile number as 18002600/18001600, allegedly to be HDFC’s customer care number. In addition, a virtual debit card was also sanctioned in his name without his consent, Kumar submitted. 

HDFC at first reversed the transaction and returned the funds to his account.

Although, later on the Bank has refunded the money, clarifying that there had been no illicit activity.

The bank informed that the OTPs sent for the transaction were validated and there was no shortcoming reported in their services. After this, Mr Kumar complained to the RBI Banking Ombudsman, who likewise determined that HDFC was not at fault, later on moving to High Court.

As per his counsel, the Bank was intending to hide the scam and refuses to give any explanation for the fraudulent creation of a virtual debit card and the unauthorised alteration of the registered contact details. It was also claimed that he did not share any of these details with anyone.

Advocates Siddharth Batra, Rhythm Katyal, Archna Yadav and Shivani Chawla appeared for Kumar.
