TVS Supply Chain Solutions (TVSSCS) has appealed to the NCLAT challenging an NCLT order regarding operational dues of ₹5.03 crore claimed from ZTE Telecom India Pvt. Ltd.

TVS Supply Chain Solutions Limited (TVSSCS) has taken an important legal step by appealing to the National Company Law Appellate Tribunal (NCLAT) in New Delhi. The appeal, filed under Section 61 of the Insolvency and Bankruptcy Code, 2016 (IBC), challenges an order made by the National Company Law Tribunal (NCLT) Chandigarh Bench on October 9, 2025.
The main issue is the recovery of operational dues totaling around ₹5.03 crore claimed by TVSSCS from ZTE Telecom India Pvt. Ltd. This dispute involves outstanding payments for work done by TVSSCS under agreements with ZTE Telecom. While TVSSCS received some payments, the rest remains unpaid.
The NCLT's original order, which TVSSCS is now contesting, dismissed the insolvency request the company filed against ZTE Telecom. The dismissal was based on NCLT's finding of a "pre-existing dispute" between the two companies over the claimed dues. This is a key point under the IBC, which prevents starting insolvency proceedings. By appealing to the NCLAT, TVSSCS aims to reverse the NCLT's decision and pursue the recovery of the claimed operational debt.

Limitation Period: The appeal must be submitted within 30 days of the NCLT's order. The NCLAT can allow an appeal to be filed after this period, but only for an additional 15 days if it finds adequate reason for the delay. The maximum time allowed for filing an appeal is strictly set at 45 days.
This action by TVSSCS highlights the company's resolve to address the ongoing financial dispute and recover the significant unpaid amount through the legal process defined by the Insolvency and Bankruptcy Code.
