IRFC gets relief from Madras High Court in GST Dispute

New Delhi: The Madras High Court overturned an Assistant Commissioner (Sales Tax) demand order for Rs 230.55 crore, giving Rail PSU Stock, Indian Railway Finance Corporation, temporary relief in its GST dispute. The case is currently remanded for further review.

"The Hon’ble High Court of Judicature at Madras has allowed the writ petitions filed by the company and set aside impugned order dated 04.12.2024 of the Assistant Commissioner (ST) of demand order for an aggregate amount of Rs 230.55 crore and the matter is remanded to the respondent for fresh consideration," as per the filing made.

This comes after the IRFC filed a writ petition contesting the initial order from December 4, 2024. Within four weeks of obtaining a copy of the court's order, the high court instructed the company to submit a thorough response along with any supporting documentation.

The tax authorities must give a 14-day notice for a personal hearing after the company files its objections. The court also mandated that any further orders must be in compliance with the law and issued only after the company has been given a fair hearing.

Furthermore, the Hon’ble High Court has also directed the company to submit its reply/objection within a period of four (4) weeks from the date of receipt of a copy of this order along with supporting documents/material," it said. With these directions, the writ petition has been disposed of, and the connected miscellaneous petition has also been closed. There are no costs imposed on either side.

Shares of IRFC are trading higher by 0.71% at Rs 129.97 on the NSE.
